    These Terms and Conditions ("Agreement") govern your access to and use of the healthcare data standardization platform and ETL (Extract, Transform, Load) tool implementation services (the "Services") provided by MITYUNG Infotech Pvt. Ltd. ("Company", "we", "our", or "us"). By accessing or using our Services, you ("User", "you", or "your") agree to comply with and be bound by the terms of this Agreement.

    All intellectual property rights in the Services, including but not limited to software, tools, documentation, and content, are owned by Company or its licensors. You may not copy, modify, distribute, or create derivative works based on our intellectual property without explicit permission.

    9. Service Availability

    While we strive to provide reliable and uninterrupted service, we do not guarantee that the Services will be error-free or available at all times. We reserve the right to suspend or discontinue the Services at any time for maintenance, upgrades, or other reasons.

    10. Disclaimer of Warranties

    To the fullest extent permitted by law, Company provides the Services "as is" and disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will meet your requirements or be error-free.

    11. Limitation of Liability

    In no event will Company be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunities arising from or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under this Agreement will not exceed the total amount you paid for the Services in the six (6) months preceding the claim.

    You agree to indemnify, defend, and hold harmless Company, its affiliates, employees, officers, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Services, violation of these Terms and Conditions, or any infringement of third-party rights.

    13. Termination

    We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. Upon termination, you will cease using the Services and any associated content, and you may request the deletion of your data, subject to our data retention policy.

    14. Governing Law and Dispute Resolution

    This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in New Delhi, India, in accordance with the rules of the Indian Council of Arbitration (ICA). The arbitration award may be entered as a judgment in any court having jurisdiction.
